• Application submitted to the registrar with relevant form and fee.
• Search by earlier Trademark. Refusal of application if it fails to satisfy the particulars.
• Advertisement of the Trademark in the journal on its acceptance.
• The advertisement may trigger opposition preceding by any person for registration of a trademark.
• In the case of no opposition, the registrar will enter the Trademark in the register of trademarks within two months of advertisement.
• Following the entry of the Trademark, the registrar will issue a certificate of registration to the applicant with a sealed registry of the Trademark.

Issuance Of Trademark Registration Certificate

When the certificate for a registered trademark is issued, the applicant or company may use the symbol (®) for their Brand. Trademark may become canceled on non-usage if it is not used five years or three months consecutively.

The Validity Period and Renewal of Trademark Registration Certificate in Pakistan

The validity period for a trademark in Pakistan is 10 years. However, you can renew it under section 35 of the trademark ordinance 2001 after the validity period.

Process For Trademark Renewal in Pakistan

• According to Section 35 of the Trademark Ordinance 2001, the applicant applies for Trademark renewal within six (06) months from the expiry date.
• For this purpose, the applicant fills two forms: one for trademark certification renewal (Form TM-12) and second for the payment of surcharge (Rs. 15,000/-) for one Trademark.
• If the applicant does not apply for the renewal process within the given period, the registrar can remove the Trademark from the register.
• In that case, the applicant will apply for the restoration of a Trademark under fee Rs. 3000/-. The duration for the acceptance of application restoration is from six (06)months to 1 year.
